The Fiancee Visa Process:

The process of submitting a Fiancée Visa is very complicated. If it is not prepared properly it can cause delays,
or it may not be approved at all. However, it is not necessary to pay an immigration attorney $1500 or even more to prepare your documents when we can provide people with a high level, quality service based on our years of experience. There will be situations when some individuals will have special circumstances that may require the assistance of an attorney, such as the foreign fiance(e) having entered the USA illegally, or the foreign fiance(e) having a criminal history. During our screening process, if we become aware of any special circumstances that require legal assistance, we will advise you to seek legal advice from an immigration attorney who qualified to help individuals with special needs.

If your Fiancée is from one of the more economically depressed countries and has never previously
been to the United States, there is only one U.S. visa that he or she will be able to obtain.
This is known as a FIANCEE VISA, also called a K visa, or K1 Visa. The chances of obtaining any other type of visa are slim to none.

You could marry your future spouse in their home country, but most likely you will have to be physically present there
for a minimum of one month before your wedding day. After that, you will have to file a Spousal Visa (K3 Visa) petition
in the U.S. and it generally takes longer (up to a year in some cases)
to obtain a visa for a spouse as opposed to using the K-1 process.

This is what is required for you
to be able to file a petition using the K-1 process:

  • You must be a US citizen. Permanent residents of the U.S. are not allowed to obtain Fiancée visas.

  • Both you and your Fiancée must be free to marry. If either of you have been previously married, you will have to be either divorced, widowed, or had your marriage annulled.

  • You must have met your Fiancée in person within the previous two years. Since it is almost impossible to obtain a visitor visa to visit the U.S.A., this means that you must go to their country to meet, or arrange to meet in another country.

  • You must meet the minimum income requirement for the fiancee visa petitioner. Please click here to see the income tables.
